These Terms and Conditions set out the basis on which Waste Removal Chiswick provides waste collection and related services. By making a booking, accepting a quotation, or allowing our operatives to commence work at your property or site, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following definitions apply:

1.6 Quotation refers to a price estimate given by us for carrying out the services, based on the information you provide and any site assessment we may undertake.

2. Scope of Services

2.1 We provide waste removal and related services for households, landlords, letting agents, offices, trade premises and other customers, subject to these Terms and Conditions and applicable law.

2.2 Our services generally include loading, removal and lawful disposal or recycling of eligible waste from your property or any agreed collection point.

2.3 We reserve the right to refuse the collection of certain items including, but not limited to, hazardous waste, clinical or medical waste, asbestos, chemical substances, gas bottles, pressurised containers, explosives, and any items that, in our reasonable opinion, pose a risk to health, safety or the environment.

2.4 Any waste we collect becomes our property upon loading into our vehicle, subject always to applicable waste regulations and duty of care requirements.

3. Booking Process

3.1 You may request a quotation or make a booking by telephone, email or through any online booking facility we make available.

3.2 You must provide accurate and complete information about the type and approximate volume or weight of waste, access conditions, location details, and any relevant restrictions such as parking limitations, time constraints, or building rules.

3.3 Any quotation provided before our arrival is an estimate only and may be revised on site if the information you provided is inaccurate or incomplete, or if the actual waste or access conditions differ from what was described.

3.4 A booking is only confirmed when we expressly accept it, which may be by telephone, email, message confirmation or by attending the property at the agreed time. We reserve the right to decline any booking at our discretion.

3.5 You are responsible for ensuring that someone authorised by you is present at the property during the agreed collection time to grant access, specify the waste to be removed, and approve any variations to the quotation.

4. Prices and Quotations

4.1 Prices are normally based on the volume and type of waste, labour involved, and any additional charges such as parking, congestion, disposal of special items, or extra time on site.

4.2 Unless otherwise stated, all quotations are exclusive of any parking fees, tolls, congestion charges or penalties incurred directly as a result of carrying out the services at your property. These additional costs may be added to your final invoice.

4.3 We will confirm the final price with you on site before commencing work where possible. By allowing us to start loading waste, you are deemed to have accepted the price for the services.

4.4 Any verbal quotation is an estimate only and is subject to revision once the waste is inspected in person.

5. Payments and Invoicing

5.1 Payment is due in full on completion of the services, unless we have agreed alternative payment terms in writing in advance.

5.2 We may accept payment by cash, debit card, credit card, bank transfer or other methods as notified by us from time to time. Cheque payments will only be accepted by prior agreement.

5.3 For commercial customers, we may agree credit terms. Unless otherwise specified, invoices must be paid within 14 days of the invoice date. We reserve the right to conduct credit checks and to withdraw or amend credit facilities at any time.

5.4 If payment is not received by the due date, we reserve the right to charge interest on the overdue amount at the statutory rate applicable under the Late Payment of Commercial Debts legislation or other relevant law, together with any reasonable costs incurred in recovering the debt.

5.5 We may withhold further services or cancel future bookings if any outstanding payments remain unpaid.

6. Cancellations and Amendments

6.1 You may cancel or amend a booking by contacting us directly by telephone or email.

6.2 If you cancel more than 24 hours before the scheduled collection time, no cancellation charge will normally apply.

6.3 If you cancel within 24 hours of the scheduled collection time, fail to provide access to the property, or are not present at the agreed time without prior notice, we may charge a cancellation or call-out fee to cover our reasonable costs.

6.4 If we arrive and are unable to carry out the services due to inaccurate information provided by you, lack of access, unsafe conditions, or the presence of prohibited or hazardous waste, we may treat the booking as cancelled by you and apply a cancellation or call-out charge.

6.5 We reserve the right to cancel or reschedule a booking due to circumstances beyond our reasonable control, including but not limited to vehicle breakdown, severe weather, road closures, staff illness, or compliance with legal obligations. In such cases, we will inform you as soon as reasonably practicable and offer an alternative date or a refund of any advance payment.

7. Access, Parking and Customer Responsibilities

7.1 You must provide safe, reasonable and timely access to your property or site for our vehicle and operatives.

7.2 You are responsible for arranging any necessary parking permits, visitor passes or building access permissions required for us to perform the services. Any parking fines or penalties incurred due to circumstances within your control may be added to your invoice.

7.3 You must clearly identify the waste to be removed. Our operatives will not be responsible for any confusion arising from unclear instructions or unsupervised premises. You should remove or clearly mark any items that you do not wish us to take.

7.4 You must ensure that the area from which waste is to be removed is reasonably clear and safe for our operatives to work. We may refuse to handle items that are dangerously placed or likely to cause injury or damage.

7.5 If our operatives are required to enter common areas, stairwells, lifts, or internal rooms to collect waste, you must ensure that such access is permitted and that you have the authority to grant it.

8. Waste Regulations and Environmental Compliance

8.1 We operate in accordance with applicable UK waste regulations, including any licensing, duty of care, and transfer note requirements. We will transport and dispose of your waste lawfully through licensed facilities wherever required.

8.2 You confirm that the waste you present for collection is not hazardous, clinical, or otherwise restricted unless we have explicitly agreed in advance and are legally authorised to handle such waste.

8.3 You acknowledge your duty of care in relation to the waste you produce. You must not request us to remove any waste that you know or suspect to be hazardous or illegal to transport or dispose of through ordinary channels.

8.4 We may issue a waste transfer note or provide other documentation where required by law. You must retain such documents for the period specified by regulations and produce them to authorities if requested.

8.5 We aim to divert waste from landfill where practicable by working with appropriate recycling and recovery facilities. However, we do not guarantee that any particular item will be recycled, reused or recovered.

9. Liability and Limitations

9.1 We will exercise reasonable care and skill in providing the services. However, our liability is subject to the limitations set out in this clause.

9.2 We will not be liable for any loss, damage, cost or expense arising from inaccurate information provided by you, from your failure to comply with these Terms and Conditions, or from your failure to obtain necessary permissions or consents.

9.3 While our operatives will take reasonable care when moving items through your property, minor scuffs or marks may occur to walls, floors, door frames or fixtures in tight or difficult spaces. We will not be liable for cosmetic damage that is reasonably incidental to the careful performance of the services in such conditions.

9.4 You must notify us in writing of any alleged loss or damage caused by us within 48 hours of completion of the services, providing reasonable details and evidence. We may inspect the alleged damage before accepting any liability.

9.5 Our total liability to you for any loss or damage arising out of or in connection with the services, whether in contract, tort including negligence, breach of statutory duty or otherwise, shall be limited to the total price paid or payable for the specific booking to which the claim relates.

9.6 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be limited or excluded under applicable law.

9.7 We shall not be liable for any indirect, consequential or special loss, or for any loss of profit, revenue, business, contracts, goodwill or anticipated savings, whether foreseeable or not.

10. Insurance

10.1 We maintain insurance cover that is appropriate for the nature of our waste collection services, including public liability insurance, subject to the terms, conditions and exclusions of the policy.

10.2 Our insurance does not cover any items that you fail to identify as valuable or fragile. You should remove or clearly mark such items and ensure that they are not included in the waste to be removed.

11. Customer Conduct and Health and Safety

11.1 You must not obstruct, intimidate or abuse our operatives. We reserve the right to withdraw our services and leave the site immediately if we consider that our staff are at risk.

11.2 We may refuse to work in conditions that we reasonably consider unsafe, unsanitary or in breach of health and safety requirements. In such circumstances, we may treat the visit as a cancelled booking and charge a reasonable fee.

11.3 You must not instruct our operatives to undertake any task that falls outside the agreed services or that may compromise health and safety or regulatory compliance.

12. Data Protection and Privacy

12.1 We may collect and process your personal data such as name, contact details, property address and payment information for the purpose of handling enquiries, bookings, service delivery, invoicing and administration.

12.2 We will handle your personal data in accordance with applicable data protection laws in the United Kingdom. We will not sell your personal data to third parties. We may share information with service providers or authorities where reasonably necessary for providing the services, complying with legal obligations, or protecting our legitimate interests.

13. Complaints

13.1 If you are dissatisfied with any aspect of our services, you should contact us as soon as possible with details of your concern.

13.2 We will aim to investigate complaints promptly and to respond within a reasonable timeframe. You agree to give us a fair opportunity to investigate and resolve any issue before taking further action.

14. Variations to Terms

14.1 We may update or vary these Terms and Conditions from time to time. The version in force at the time you make a booking will apply to that booking.

14.2 Any changes that we make will be published or otherwise communicated, and continued use of our services following such changes will constitute acceptance of the updated Terms and Conditions.

15. Severability

15.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted.

15.2 Any such modification or deletion shall not affect the validity and enforceability of the remaining provisions.

16. Entire Agreement

16.1 These Terms and Conditions, together with any written quotation or service confirmation we provide, constitute the entire agreement between you and us in relation to the services, and supersede any prior discussions, correspondence or understandings.

16.2 You confirm that you have not relied on any statement, promise or representation that is not expressly set out in these Terms and Conditions.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of our waste removal services, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 You and we both agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, their subject matter or formation including non-contractual disputes or claims.

By confirming a booking or permitting our operatives to commence the removal of waste from your premises, you acknowledge that you have read, understood and agreed to these Terms and Conditions.
